Patent is granting exclusive rights for an invention to make, to use and to sell the invention for a period of 20 years. Patent is only granted to an innovative and new product or process which comes under the patentability requirements as per the Law. We offer services of patent searches, advices/consultancy, application preparation & filing, legal actions, hearings, acceptance and sealing, filing and defending oppositions, revocation proceedings before the Controller of Patents & appeals in Hon’ble Court, patent litigations, annuities & matters after post granting of patent.
Introduction:
A patent is basically granted of exclusive rights for an invention by the government to the inventor to make, use and sell the invention for a specific period of time. The registered patent prevents the unauthorized use of the invention other than the inventor itself. In order to be patentable, the invention should be an exclusive idea, process & product, novel & new, an inventive steps and capable of industrial application.

Importance of Design registration:
The patent registration brings you massive benefits while keeping all the fraudulent opponents away. It enhances the inventor’s reputation in the market and brings positive image to the portfolio by making open appearance of the invention in public. It brings prosperity to the business interest of the holder while enabling premium. Further, it offers an opportunity to the holder to use his ideas, quick security to the inventions, prohibit unauthorized use of inventions, advantageous for a prolonged period, improves credibility and provides a true legal status to the inventor.
Requirements:
- Full name, nationality, profession and complete business address of the applicant.
- 03 copies of specification and claims in English on a prescribed paper size.
- 03 copies of drawings in prescribed manner, if any.
- Application form and endorsement of the reverse by the inventor in presence of two witnesses, only if inventor is not applicant.
- Power of Attorney duly signed by authorized signatory and notarized by notary public.
- In case of priority application, certified copy of basic specification is filed with the application in country or within 03 months. Priority can be claimed for corresponding applications filed in WTO member countries by filing applications in Pakistan within 12 months from the date of first foreign application.
Procedure:
- The application for granting of patent is filed at the patent office in the prescribed application form.
- Provisional/Complete Specification and Power of Attorney together with the prescribed fee is submitted with the application form.
- The application with the compliance is then examined at the patent office. After the prescribed period, the examiner raises objections if any and notifies the applicant to file reply.
- Upon reply of the objections, if the examiner is satisfied, the application is accepted for the granting the patent. In case of no satisfaction, the application for granting patent is rejected. However, the applicant can appeal to Hon’ble court within 90 days from the date of rejection.
- The accepted applications are officially published in the official gazette to open for public for oppositions, if any, within 120 days.
- If any opposition raises, the patent has to overcome the opposition.

Duration & renewal:
The term of patent granted is 20 years from the date of filing, subject to the annual renewal payments. Once the patent expires, it enters the public domain.
